Darcy Terms of Service

1. Definitions

Service: The Darcy platform and its functionalities, including facilitating AI phone calls, matching you with potential partners, and allowing interactions between matched users.
User: An individual who has shared their phone number or email address with Darcy (or otherwise registered) and completed an AI phone call with Darcy.
Profile Information: Information (public or otherwise provided by you) that is used to facilitate matches and introductions via Darcy.

2. Eligibility

You must be at least 18 years old to use the Service. By using Darcy, you represent and warrant that you meet this age requirement.
Darcy reserves the right to request proof of age from any User and to terminate or suspend accounts of Users found to be under 18.

3. Registration and Service Access

To register and use Darcy, follow these steps:

Initial Contact

You provide Darcy with your email address and/or phone number.
You may receive instructions on how to begin the AI phone call or otherwise initiate your matching process.

Phone Call and Terms Acceptance

After receiving your contact information, Darcy will initiate an AI-powered phone call with you.

By participating in this phone call, you:

Accept these Terms of Service.
Authorize Darcy to collect and use certain information you provide.
Agree to be added to Darcy's matching pool.
Understand that relevant profile information may be shared with potential matches.

User Status

You are not considered a User, and these Terms do not take effect, until you complete the required AI phone call with Darcy.
Prior to completing the call, no matching or introduction services will be provided.

Opt-In Message Confirmation

After a Consumer opts in to any Darcy program or service (including text-based or phone-based signups), an immediate confirmation message must be sent to comply with opt-in requirements. This message will include:

Thank you for subscribing to Darcy, an AI matchmaker. We'll help you find your ideal partner through short phone calls and AI-driven matchmaking. Reply STOP to opt out anytime. For assistance, email contact@heydarcy.com. Message & data rates may apply. Expect up to 2 messages per week.

4. User Conduct

Users are expected to maintain respectful behavior when interacting with Darcy and with other users. Prohibited conduct includes, but is not limited to:

Using offensive, discriminatory, or inflammatory language.
Engaging in hostile or aggressive communication.
Making inappropriate personal remarks or threats.
Deliberately attempting to manipulate or misuse the AI system.
Harassing or bullying other Users.

Violations may result in restrictions or removal from Darcy's network at Darcy's sole discretion. Darcy reserves the right to take necessary actions to ensure a positive experience for all Users.

5. AI Phone Call and Service Activation

Required Step

The AI phone call is mandatory to activate your Darcy account and join the matching pool. During this call, Darcy will gather information about you (e.g., preferences, interests) to facilitate accurate matching.

Responsibility for Charges

You are responsible for any phone carrier charges or fees incurred during your call with Darcy.

Profile Information

Darcy will use the information you provide (and any publicly available data you consent to share) to build your profile for matchmaking.
Personal information beyond what is publicly available will only be shared if both parties opt in.

6. Privacy and Data Protection

Darcy employs strict data protection measures. See our Privacy Policy for full details. Key points include:

Phone numbers are only shared between Users if both parties explicitly opt in to connect.
Profile information is used to facilitate matches.
All User data is handled in accordance with Darcy's Privacy Policy.

7. Internal Data Access and Usage

The Darcy team may access and monitor:

User conversations with Darcy (including phone calls and messages).
Email communications with Darcy.
User behavioral data to improve the product experience.

Access is strictly for:

Monitoring and preventing abuse.
Improving product features.
Resolving user issues.
Ensuring service quality and safety.

Darcy maintains strict confidentiality protocols, and no individual user data is exported or used for external purposes unless explicitly authorized by the user or required by law.

8. Third-Party AI Processing

To provide its services, Darcy uses industry-leading AI providers (e.g., OpenAI, Anthropic). By using Darcy:

You acknowledge that your interactions may be processed by these AI services.
These third-party providers may retain processed data per their policies.
We select providers based on their security practices and reliability.

9. Service Operation and Matching Process

By using Darcy, you understand and agree that:

You will be placed in Darcy's matching pool after your AI phone call.
Your phone number is shared only after both parties explicitly opt in.

10. Safety and Well-being Measures

Darcy is intended for matchmaking and building connections. It is not a substitute for professional advice, including mental health or legal services. If you feel unsafe or uncomfortable during any interaction, discontinue the conversation immediately and contact contact@heydarcy.com.

12. Feedback

Darcy values User feedback. By submitting feedback or suggestions, you grant Darcy a worldwide, royalty-free, perpetual, irrevocable license to use and incorporate your feedback without restriction.

13. Intellectual Property

The Service and its original content, features, and functionality are owned by Darcy and its licensors. You agree not to copy, modify, or distribute any part of the Service without prior written consent.

14. Payment and Fees

Darcy's core features are currently free. You are responsible for phone or data charges from your carrier. If Darcy introduces any paid plans in the future, Users will be notified, and continued use constitutes acceptance of new fees.

15. Limitation of Liability

Darcy is not liable for any outcomes related to matches or interactions facilitated by the Service. Connections made are on an "as is" basis. Darcy does not guarantee success, any particular results, or specific outcomes.

To the fullest extent permitted by law, Darcy shall not be liable for indirect, incidental, special, or consequential damages from using its services.

16. "AS IS" and "AS AVAILABLE" Disclaimer

Darcy's services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no express or implied warranties regarding service availability, functionality, or your satisfaction.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Any disputes arising hereunder are subject to the exclusive jurisdiction of Delaware courts.

18. Changes to the Terms

Darcy may update these Terms from time to time. Material changes will be communicated via email or platform notifications. Continued use after updates constitute acceptance of the revised Terms.
